We are registered under the law 126-02 art. 21 until Dominican Law releases a non-literally mandatory “Data Protection law”, and as such, any information concerning the Client and their respective Client Records may be passed on. However, Client records are regarded as confidential and therefore will not be divulged to any third party, other than [internal department designed as Reservations/Customer Service] if legally required to do so to the appropriate authorities. Clients have the right to request sight of, and copies of any and all Client Records we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Client’s with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties. We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by email@example.com or firstname.lastname@example.org will only be in connection with the provision of agreed services and products.
Exclusions and Limitations
The information on this web site is provided on an “as is” basis. To the fullest extent permitted by law: Excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages. We do not however exclude liability for death or personal injury caused by its negligence. The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.
Payment deposit per villa reservation is due upon booking. Cash, Bank Deposits to the Private account in the designated Bank under the name BANCO POPULAR DOMINICANO, online payment via PayPal, are all acceptable methods of payment. Note: Debit cards are only valid in your presence.
We reserve the right to seek recovery of any money remaining unpaid sixty days from the date of invoice.
A Deposit totaling from 300.00 USD only by cash payment. This rule is mandatory and not negotiable.
Applicable Cancellation Policy
If cancelled prior to 30 days before date of arrival, one night will be charged.
If cancelled prior to 7 days before date of arrival, 50 percent of total price of the stay will be charged.
If cancelled later or in case of no-show, the total price of the reservation will be charged.
Basic Rules and Regulations for the Residents of our Villa
Music at a moderate volume is allowed, keeping in mind respecting the tranquility of our neighbors. Hours for music are until 11.00 pm.
FIREARMS, ILLEGAL DRUGS AND NARCOTICS ARE NOT PERMITTED.
Each adult client can have one registered guest at a time unless maximum capacity of 8 persons of the villa has been met.
4 Bedroom Villas – Max. Occupancy family of 8 persons (Any combination: Adult/Children not exceeding 8 persons in total), 8 Adults (4 couples) or 8 Persons (4 Singles and 4 Guests).
4 Bedroom Villas – up to 8 persons until 11 pm, overnight guests are not allowed in the Villa
Special Events: Any special even like pool party, bachelor party, birthday party are not allowed.
Alarm System of Villa Jacaranda:
Always activate the alarm system if the last person is leaving the villa and nobody is at home anymore, it is for your own security. The owner will show you how the alarm system works (very simple) and you will receive the code from him. The tenants will receive maximum 2 house keys and 2 remote control for the entrance gate.
Guests may check-in at any time from 3.00 p.m. on day of arrival. If a guest has not checked-in by 11.00 p.m., the owner is entitled to re-let the villa unless the guest has notified the owner that he/she will be arriving late.
On departure, guests must vacate the villa and check-out by no later than 12.00am. Guest may request late checkout through the owner, this cannot be guaranteed.
House and Pool Cleaning
Cleaning of the Villa: 3 times a week: Monday, Wednesday and Friday Cleaning of the Pool: 3 times a week: Monday, Wednesday and Friday The bed linen is changed once a week: Every 7 days The towels are changed 3 times a week: Monday, Wednesday and Friday
Guests must pay all outstanding charges on departure. We accept all major debit & credit cards except American Express. We reserve the right to keep the hold and charge up to but not restricted to 3 days after departure. The owner reserves the right to use the guests credit card hold to deduct from their account any unpaid outstanding balances i.e. late room charges, fumigation of the bedroom, damage charges.
Right of Refusal
The owner reserves the right to refuse a guest entry and accommodation if, on arrival, management reasonably considers that the guest is under the influence of drink or drugs, previously blacklisted, is unsuitably dressed or is behaving in a threatening, abusive or otherwise unacceptable manner.
Losses, Liabilities etc.
Guests must report any loss of or damage to their property immediately on discovery to the owner of the villa and he shall make himself available to assist with any reports made by the owner to the police.
Property that is left behind in the guest rooms will be kept for 3 weeks. All unassigned property will be forwarded to a charity or disposed of depending value. If we send articles back to the customer, we will charge a postage and packaging fee to the credit card on file.
Villa Jacaranda shall not be liable to a guest for any loss or damage to property caused by the misconduct or Negligence of a guest or an Act of God, or where the guest remains in exclusive charge of the property concerned. Villa Jacaranda shall not be liable for any failure or delay in performing any of its obligations under this Agreement if the failure or delay was due to any cause beyond its reasonable control, including (without limitation) war or threat of war, civil or political action or disturbance, riot, natural disaster, fire, epidemic, bad weather, terrorist activity (threatened or actual), military activity, governmental or regulatory action, industrial dispute, act of God, failure of power or machinery, failure of or interruption in externally provided services and utilities, and all similar events outside Villa Jacaranda.
For the avoidance of doubt, the owner does not exclude its liability for death or personal injury caused by the owner negligence. Guests should also refer to the Notice relating to Loss or Damage to the owner. Guests will be liable for any loss, damage or personal injury they may cause at Villa Jacaranda Conditions shall be governed by Dominican law and you agree to submit to the jurisdiction of the Dominican courts.
Termination of Agreements and Refunds Policy
We ourselves reserve the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway.
Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or manmade eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavors to comply with the terms and conditions of any Agreement contained herein.
Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.
The Dominican laws compiled under the name “Constitution” govern these terms and conditions. By accessing this website [and using our services/buying our product] you consent to these terms and conditions and to the exclusive jurisdiction of the Dominican courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of the Company to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision. These Terms and Conditions shall not be amended, modified, varied or supplemented except in writing and signed by duly authorized representatives of the owner.
